  • Your personal data is processed by: Luxcontrol SIA, registration number: LV40103589934 , legal address: Ziedu 38, Carnikava, Ādažu nov., LV-2163, Latvia, which independently determines the purposes and means of personal data processing.
  • Luxcontrol Ltd determines the purposes and means of processing of personal data, such as for branding, marketing, financial, human resources, etc., administrative and relationship management of business, goods, services, customers, suppliers and business partners.
  • LuxControl Ltd is independently responsible for the processing of personal data for its own purposes, such as the performance of contractual obligations, the processing of data for retail purposes, etc.

 

LuxControl processes personal data for the following purposes:

1. for the provision of services and the sale of goods in the salon in person and on the websites maintained by LuxControl: www.luxcontrol.lv, for the purpose of customer identification, customer service, conclusion of a purchase contract, distance contract, delivery of goods and administration of payment. For this purpose, we may contact you using the contact details you provide (telephone number, e-mail address, postal address, as well as through sms notifications from the service and to receive your evaluation of the service you have received in order to improve efficiency). The legal basis for the processing of these data: Article 6(1)(b) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter referred to as "the Regulation") Article 6(1)(b) of the Regulation: the processing is necessary for the performance of a contract to which the data subject is a party or to take measures at the request of the data subject before entering into a contract, Article 1 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC, Article 6(1)(b) of the Regulation.Article 6(1)(f) of the Regulation: processing is necessary for compliance with a legal obligation to which the controller is subject - performance of obligations and keeping of accounts, in accordance with the Law on Accounting, the Law on Annual Accounts and Consolidated Annual Accounts of the Republic of Latvia, Cabinet Regulation No. 585 "Regulations on the keeping and organisation of accounts", Civil Procedure Law, etc. Accounting records are kept for 5 years, or up to 10 years in case of default.

2. for the provision of LuxControl service (warranty and post-warranty service) for the purpose of providing warranty service to LuxControl installers and partner manufacturers for products, which includes service, and warranty and post-warranty repair, preventive maintenance, problem solving for LuxControl products or customer visits.

The legal basis for processing these data is: Article 6(1)(b) of the Regulation: processing is necessary for the performance of a contract to which the data subject is a party or for taking pre-contractual measures at the request of the data subject; and Article 6(1)(c) of the Regulation: processing is necessary for compliance with a legal obligation to which the controller is subject - Article 16 of the Consumer Rights Protection Law.

3. for financial, accounting and personnel accounting - for accounting purposes, resource planning, accounting for services rendered, payment, tax, debt administration; accounting for goods/services received, payment; accounting for information required for employee relations, payroll accounting; accounting for payments to the company. Legal basis for the processing of this data. "Regulations on the keeping and organisation of accounts", Labour Law, legislation governing taxes and other compulsory contributions imposed by the State (SSAOI, PIT), Civil Procedure Law (withholding). Accounting records are kept for 5 years, or up to 10 years in case of default.

4. for the administration of administrative and legal affairs, record keeping, for the purpose of incoming and outgoing correspondence, record keeping and administration of documents, for the conclusion or performance of a contract with You, for the performance of legal obligations imposed on Us, as well as in cases where such actions are necessary to meet Our legitimate interests or those of third parties.
Legal basis for processing these data: Article 6(1)(c) of the Regulation: processing is necessary for compliance with a legal obligation imposed on LuxControl by external law - Commercial Law, Civil Law, Law on Information Society Services and other external law; for the performance of the obligations assumed. Data is stored for up to 10 years.

5. for personnel administration, with a view to managing the personnel development of LuxControl employees, managing the motivation system and remuneration, managing the professional development and certification of staff, personnel selection, administration of employment relations, keeping whistleblower records, building a positive, loyal team and a positive team climate.

The legal basis for the processing of these data: Article 6(1)(c) of the Regulation: to comply with a legal obligation imposed on the Controller by an external law - the Labour Law, the Accountancy Law and specific external laws in the core business sector; and Article 6(1)(a) of the Regulation: the data subject has given his or her consent to the processing of personal data for one or more specific purposes. The data are kept for between 1 and 75 years, subject to the statutory retention period.

Recruitment documents are kept for 4 (four) months without the establishment of an employment relationship. If, when applying for a job, you wish to have your application and curriculum vitae (CV and/or motivation letter) stored for future recruitment for other vacancies within the LuxControl group of companies, please state when submitting your application: "I agree that my application and curriculum vitae, together with any other documents attached to it, are stored by LuxControl and may be used for future recruitment for other vacancies within LuxControl for a period of 1 year".

6. promotion, advertising and distribution of services; development of new goods and services; improvement of goods and services, customer retention, loyalty, satisfaction measurement for LuxControl brand management, internal and external marketing communications, corporate events activities, media relations and advertising management, new customer management, employee recruitment management, corporate culture, publicising achievements/performances, building a loyal team.

Public presentation of LuxControl's projects or other corporate activities in internal and external communication channels is a legitimate interest of LuxControl. LuxControl shall ensure that information on the public format of the event is provided by announcing the event in its invitations or by posting an appropriate notice at the venue of the event. Active actions (in particular, if informing about the public format of the event) of persons attending a LuxControl corporate event shall be deemed to constitute their consent to the coverage of the event (written, photo, video) on internal and external LuxControl information channels, incl. LuxControl's website(s) and social media accounts.

The disclosure of photographs/videos and other personal data of the data subject from LuxControl corporate events or projects may not significantly restrict the rights of data subjects, as they are depicted solely in the context of the data subjects' professional activities at LuxControl.

The legal basis for the processing of these data is Article 6(1)(a) of the Regulation: the data subject has given consent to the processing of his or her personal data for one or more specific purposes, and (f): LuxControl's legitimate interests - to carry out customer retention activities, to inform the public about its activities, etc.

Published Interviews, opinions, photos/videos from corporate events, stored independently for future marketing purposes. Surveys, opinions (if containing personal data)- kept for up to one year. Other data is stored as necessary.

7. Video surveillance in the office for the security of LuxControl property and persons, prevention of theft and fraudulent activities in the LuxControl office, recording of criminal offences, identification of potential offenders.

The legal basis for the processing of these data: the Article 6(1)(f) of the Regulation - LuxControl's legitimate interests - the security of property and persons, the prevention of fraud, the protection of legitimate interests before public authorities and the courts, the efficiency of the provision of services. The purpose of video surveillance, security of property and persons, is in the common interest of society as a legitimate interest of an undertaking and therefore outweighs the restriction of the rights of an individual data subject.

CCTV recordings are stored for up to 30 days. If the data have been previously requested from the competent state or local authorities or security breaches have been detected, the data shall be stored as necessary.

8. for the functionality of the website www.luxcontrol.lv, processing of cookies, analysis of social network visit history, in order to improve the functionality of the website, improve the quality of the website content and adapt the website to the needs of users. The legal basis for processing this data is the legitimate interests of the controller and/or your consent (Article 6(1)(a) and (f) of the Regulation). 9. For the purpose of sending commercial communications to inform you about our services, products and special promotions, the legal basis for processing this data is: Article 6(1)(a) of the Regulation: the data subject has given consent to the processing of his/her personal data for one or more specific purposes. The consent given by the customer to receive commercial communications is valid until withdrawn (also after termination of the service contract). The Customer may at any time opt-out of receiving further commercial communications in any of the following ways:

  • by sending an email to info@luxcontrol.lv;
  • using the automated opt-out option provided in the commercial communication by clicking on the unsubscribe link at the end of the commercial communication (email). LuxControl will stop sending commercial communications as soon as the Customer's request to withdraw consent to commercial communications has been processed.
  • Editing settings in your profile luxcontrol.lv on the website.

10. for other specific purposes, of which the Customer is informed at the time of providing the relevant data to LuxControl.

 

How we receive your personal data and why you need to provide your personal data

We receive personal data from you directly when you purchase a product/service at LuxControl's offices or on LuxControl's websites, as well as when you visit us at our actual address in the customer centre: CCTV recordings and website and app cookies, correspondence, etc.  The provision of data is necessary for us to be able to provide you with an adequate, quality service and to comply with any legal obligations to which we are subject. In certain circumstances, failure to provide information may make it difficult or impossible for us to provide our services.

 

Recipients of personal data

LuxControl shall not disclose to third parties personal data or any information obtained during the provision of the services and the performance of the contract, except:

  • where the third party is required to provide the data in the context of a contract in order to perform a function necessary for the performance of the contract or delegated by law (e.g. to a bank for settlement purposes, to a certified public accountant);
  • in accordance with the explicit and unambiguous consent - request - of the data subject:
    • in the case of delivery of goods to a courier or service company of a partner;
    • in the case of insurance of goods, the insurance service company of your choice.
  • other bodies provided for in the laws and regulations, or upon their justified request, in the manner and to the extent provided for in external laws and regulations.
  • to protect LuxControl's legitimate interests, for example, by bringing legal action in court or before other public authorities against a person who has infringed LuxControl's legitimate interests.
    LuxControl may transfer personal data to its business partners (processors) for the performance of certain activities to the extent necessary for the performance of the specific tasks. LuxControl's business partners provide guarantees that ensure the processing and protection of personal data in accordance with LuxControl's requirements.

LuxControl does not transfer personal data to third countries (i.e. countries outside the European Union and the European Economic Area), unless this is directly related to the provision of services in a third country. If the provision of the service requires the transfer of personal data to a third country, LuxControl shall ensure that the safeguards required by law and the legal basis for the transfer are obtained.

Your personal data is not used for automated decision-making.

 

Right of access to your personal data

You have the right to request access to, rectification, erasure or restriction of processing of your personal data in accordance with laws and regulations, or the right to object to processing (including processing of personal data based on LuxControl's legitimate interests), as well as the right to data portability. These rights are exercisable insofar as the processing of data does not result from obligations imposed by applicable laws and regulations.

A request to exercise your rights can be made by:

  • in writing in person at LuxControl's registered office, upon presentation of an identity document;
  • by electronic mail (sending an e-mail to the addressees indicated in this document), signed by a secure electronic signature.

LuxControl shall ensure compliance with data processing and data protection requirements in accordance with laws and regulations and shall provide information that can be reasonably collected. In the event of an objection by an individual, LuxControl shall take the necessary steps to resolve the objection. However, if this fails, you have the right to apply to the supervisory authority, the State Data Inspectorate.

 

How you give consent to the processing of your data and how to withdraw your consent

Individuals give their consent to the processing of personal data in writing, orally or by a specific free and informed act.  Individuals' active participation in LuxControl corporate events shall be deemed to constitute their consent to the public format of the event (in particular, where information activities have been carried out, such as by means of invitations and notices posted at the event venue about the public format of the event) and shall include their consent to the publication of photographs and videos from the event venue on LuxControl's internal and external communication channels.The person has the right to withdraw the consent to data processing at any time by notifying us electronically by e-mail. In this case, no further data processing based on the consent previously given for the specific purpose will be carried out. Withdrawal of consent shall not affect the processing of data carried out at the time when the consent was valid. Withdrawal of consent shall not interrupt the processing of data carried out on the basis of other legal grounds.
